This personal data protection policy (hereinafter, the "Privacy Policy") details the processing of personal data potentially collected by YMV&Co., the data controller, on the website www.ymvconsulting.com (hereinafter, the "Site").This Privacy Policy applies to personal data provided and/or concerning natural persons (hereinafter, the "person(s) concerned" or the "individual(s)"), in accordance with the regulations in force in France as issued by the General Data Protection Regulation EU 2016/679 of April 27, 2016, known as the "RGPD", and the French Data Protection Act no. 78-17 of January 6, 1978, known as the "Informatique et Libertés" Act. In this case it concerns users of the Site and any person who wishes to collaborate with YMV&Co. as a potential candidate or partner company. The use of the pronoun "he" includes all genders and this policy applies to all persons concerned without distinction.
This Site is not intended to collect personal data from minors under the age of 16 who are of legal working age. Consequently, YMV&Co. cannot be held responsible for any unwanted collection from children under the age of 16 and will do its utmost to systematically delete any such collection.
1. Définitions
The term "data controller" refers to the natural or legal person who determines the purposes and means of processing personal data collected on the Site or by any other means.
The term "personal data" or "personal data" refers to any information relating to an identified or identifiable natural person. An "identifiable natural person" is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.

2. The data controller

Depending on his or her capacity, the individual may be asked to provide personal data such as name/first name; personal or professional e-mail address (for consulting assignments); CV or any other information containing personal data when communicating electronically at the following address: yv@ymvconsulting.com, by telephone or by post. This may also include publicly available information that the data controller may collect in addition to information directly provided by the individual; for example, data available on social networks (including Linkedin).
The individual undertakes to provide correct and up-to-date personal data, and guarantees not to make any false declarations or provide any intentionally erroneous information.
YMV&Co. does not collect sensitive data - unless applicable territorial exceptions apply (for example, in some countries data such as ethnic origin and/or religion may be required, but the individual will be previously informed of such a need and will be free not to transmit this information to YMV&Co. but directly to the company in strict compliance with the principle of data minimization as defined in Article 5.1.c. of the RGPD.
4. Purpose and legal basis of personal data collection
The personal data collected by the data controller is strictly necessary and related to the provision of services by YMV&Co.
Processing is justified by the legitimate interest of the data controller, the need to process such information for the purpose of fulfilling a contract (or the proper performance of services), or when it is necessary to comply with a legal obligation to which YMV&Co. is subject.
If none of these legal bases is applicable, the data controller will ensure that it has obtained the prior consent of the individual for one or more specific purposes. Consent is characterized by the free, specific, informed and unambiguous expression of will by which the data subject accepts, by a declaration or by a clear positive act, that personal data concerning him or her may be processed.
5. Recipients of individuals' personal data
5.1. Companies YMV&Co. works with and potential candidates
As part of its mission, YMV&Co. is committed to transferring the personal data of individuals whom it considers to be suitable candidates for the companies with which it collaborates. The transfer of such data takes place only when necessary, i.e. in order to fill a position that corresponds to the criteria and expectations of the candidate(s) and the company in search. YMV&Co. cannot be held responsible for personal data that the individual shares with the company (third party) and that YMV&Co. was not aware of or did not deem appropriate to share.
It should be noted that the companies with which YMV&Co. collaborates act as independent data controllers and define the purposes for which they collect personal data from individuals. In the event that an individual does not wish his or her information to be shared with a particular company or companies, he or she must expressly inform YMV&Co. in advance.
5.2. Other recipients
YMV&Co. is committed to respecting personal data. If as part of its headhunting and/or consulting activities, YMV&Co. needs to transfer personal data to third parties (e.g. other than the companies with which it collaborates for a work placement), this will only be done after ensuring that the individual has been duly informed and in strict compliance with the RGPD.
5.3. The webhost, Cargo
Cargo may collect, store and process some of your personal information, always as a data processor. As a visitor to the YMV&Co. website, please note that YMV&Co. remains the data controller and no direct relationship exists between you and Cargo; in the event that you exercise any of your rights as a data subject (see section 9 below), YMV&Co. will require Cargo to take any appropriate action in accordance with applicable law.
6. Location of personal data
The personal data collected is processed by YMV&Co. within the European Union. In the event that, in the context of its headhunting and/or consulting activities, the recipient of the personal data is located outside the European Economic Area, YMV&Co. ensures that this recipient acts in compliance with adequate security and confidentiality requirements (at least protection similar to that conferred by the regulations in force at European level).
7. How long personal data is kept
Personal data is kept by YMV&Co. for the time strictly necessary to achieve the purposes for which the data is collected and processed. This is determined by the duration of the commercial relationship or the time required to process the request. In general, YMV&Co. retains individuals' data for a period of 12 months from the date of collection, unless the individual wishes his or her data to be retained for a longer period (for example, so that YMV&Co. can study the individual's CV when appropriate and discuss potential offers spontaneously from time to time if the offer for which he or she was initially approached has not been successful).
In addition, YMV&Co. may archive the personal data of individuals who have been successfully placed for a period of three years (unless a legal exception shortens or increases such a period). Such archiving implies limited and justified access to personal data for the time necessary to comply with YMV&Co.'s legal and regulatory obligations and/or to enable it to assert its legal rights, before it is permanently deleted.
8. Security and confidentiality of personal data
YMV&Co. undertakes to process the personal data of individuals lawfully, fairly, transparently, proportionately and in strict compliance with the purposes pursued and stated. The technical and organizational measures required to ensure the security and confidentiality of personal data are implemented and regularly updated by YMV&Co.
Cargo, the web host, has implemented security measures designed to protect the personal information that YMV&Co. collects on the website. Among other things, Cargo offers secure HTTPS access to most areas of its services and regularly monitors its systems for potential vulnerabilities and attacks, and regularly looks for new ways and third-party services to further improve the security of its services and the privacy of its visitors/users.
9. Exercising individual rights to personal data
9.1. Individual rights
In accordance with the GDPR (Articles 15 to 21), individuals have the following rights to their personal data (subject to applicable exceptions, on a case-by-case basis)
9.1.1. Access rights
The data subject shall have the right to obtain from the controller confirmation as to whether or not personal data relating to him or her are being processed and, where they are, access to the said personal data as well as the following information:
a) the purposes of the processing;
b) the categories of personal data concerned;
c) the recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients established in third countries or international organizations;
d) where possible, the length of time for which the personal data will be kept or, where this is not possible, the criteria used to determine this length of time;
e) the existence of the right to request from the controller the rectification or erasure of personal data, or a restriction on the processing of personal data relating to the data subject, or the right to object to such processing;
f) the right to lodge a complaint with a supervisory authority;
g) where personal data is not collected from the data subject, any available information as to its source;
h) the existence of automated decision-making, including profiling, and the significance and anticipated consequences of such processing for the data subject.
Where personal data is transferred to a third country or to an international organization, the data subject has the right to be informed of the appropriate safeguards with regard to such transfer.
9.1.2. Right of rectification
The data subject has the right to have his or her personal data collected and processed by the data controller rectified or completed if it proves to be inaccurate or incomplete.
9.1.3. Right to erasure (or the right to be forgotten)
The data subject may request the deletion of his or her personal data as soon as possible, except for data required for the establishment, exercise or defense of legal claims. Where legal exceptions apply, the data controller will ensure that access to such personal data is strictly limited to those entitled to it.
9.1.4. Right to restrict processing
- This right applies when:
- the accuracy of the data is disputed, so that YMV&Co. can carry out the necessary checks;
- the processing is unlawful and the data subject objects to the deletion of the data but demands instead that their use be restricted;
- the data is no longer processed by YMV&Co. but may still be necessary for the contestation, exercise or defense of legal claims.
9.1.5. Right to portability
This right entitles the data subject to receive his or her data in a structured, commonly used and machine-readable format, provided that the processing is carried out using automated procedures.
9.1.6. Right to object
The data subject may object to the processing of personal data, subject to a compelling legitimate interest overriding this right.
9.1.7. Right to withdraw prior consent
When an individual's personal data is processed on the basis of his/her prior consent, he/she may withdraw it at any time. Withdrawal of consent is valid only for future processing of personal data, and has no impact on past processing, which remains legitimate.
9.2. Exercising rights
For the purposes of exercising their rights of access, rectification, erasure, limitation, portability, opposition and withdrawal of consent, but also for any complaint relating to their personal data, the individual should address their request to:

YMV&Co. will provide a response to the individual within a maximum of one (1) month from receipt of the request. This period may be extended by two (2) months depending on the complexity and number of requests. The exercise of these rights is exclusively free of charge for the individual, with the exception of repetitive and/or disproportionate requests, for which YMV&Co. would be entitled to demand reasonable compensation (subject to having informed the individual in advance).
9.3. The possibility of lodging a complaint with the CNIL
